1. Agreement to Terms

By accessing or using ListingLab ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

ListingLab is a tool that helps Etsy sellers create product listings by:

• Generating product mockups using your Dynamic Mockups API key
• Creating AI-powered SEO-optimized titles, descriptions, and tags
• Facilitating the creation of draft listings on Etsy via the Etsy API

Important: ListingLab does not provide mockup generation services directly. You must bring your own Dynamic Mockups API key. We provide the workflow automation and AI content generation.

3. Third-Party Services

ListingLab integrates with third-party services. Your use of these services is subject to their respective terms:

• Etsy API: You must comply with Etsy's API Terms of Use
• Dynamic Mockups: You are responsible for your own API key and usage costs
• OpenAI: AI content generation is powered by OpenAI's services

4. User Responsibilities

You agree to:

• Provide accurate information when creating an account
• Maintain the security of your account credentials
• Use the Service in compliance with all applicable laws
• Not use the Service for any unlawful or fraudulent purpose
• Not attempt to circumvent any security measures
• Be responsible for all content you create and publish
• Obtain and maintain your own API keys for third-party services

5. API Keys and Data

You are responsible for:

• Obtaining your own Dynamic Mockups API key
• Any costs associated with your API usage
• Keeping your API keys secure
• Complying with the terms of service of third-party API providers

We store your API keys securely but you remain responsible for their use and any associated costs.

6. Intellectual Property

You retain all rights to the content you create using ListingLab. ListingLab and its original content, features, and functionality are owned by ListingLab and are protected by international copyright, trademark, and other intellectual property laws.

7. Fees and Payment

ListingLab may offer both free and paid subscription tiers. Fees for paid services will be clearly stated before you subscribe. You agree to pay all fees associated with your chosen subscription tier.

Note: Fees for third-party services (Dynamic Mockups, Etsy, etc.) are separate and paid directly to those providers.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTINGLAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We are not responsible for:

• Issues with third-party services (Etsy, Dynamic Mockups, etc.)
• Quality or accuracy of AI-generated content
• Costs incurred from third-party API usage
• Listings created on Etsy or their performance

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
